Research / Research News / BUiD academic staff and student co-author a research paper on the UAE Arbitration Law’s Fundamental Principles
Dr Omar Alhyari, Associate Professor and Programme coordinator of MSc Construction Law and Dispute Resolution (CLDR) and Saed Shamout, student on the CLDR programme, co-authored a research paper titled, ‘A Review of the UAE Arbitration Law’s Fundamental Principles using the UNCITRAL Model Law as a Global Standard’, in the International Arbitration Law Review
The research examines how the UAE Arbitration Law aligns with and diverges from the UNCITRAL Model Law, which serves as a global benchmark for arbitration legislation. Using a doctrinal approach, it compares both frameworks across four principles—fairness and equality, comprehensiveness, party autonomy, and limited court intervention—to evaluate the UAE’s adherence to international standards while identifying unique local adaptations.
