BUiD’s academic staff co-authors research on restitution under Jordanian law

Dr Derar Al-Daboubi, Assistant Professor at the Faculty of Business and Law, co-authored research titled “Aspects of Restitution in the Context of Injurious Act” which is in Kutafin Law Review.

The paper delved into the principles of restitution under Jordanian law, placing particular emphasis on how restitution functions within the framework of tortious liability. The authors, Derar Al-Daboubi, Sahib Al-Fatlawi, and Mohamed Abdel Khalek Al Zoubi, explored various dimensions of restitution, a legal obligation typically associated with contractual liability, where a debtor is required to fulfil what they committed to under the law—ultimately ensuring the creditor’s satisfaction.

In their paper, the authors, Derar Al-Daboubi, Sahib Al-Fatlawi, and Mohamed Abdel Khalek Al Zoubi, examined the principles of restitution under Jordanian law from various aspects, with a primary focus on restitution within the context of tortious liability.

What sets this research apart is its focus on a largely unaddressed issue: the lack of explicit provisions for restitution in tortious contexts within Jordanian legislation. The paper offers a detailed critique of the Jordanian Civil Code and other relevant legal texts, aiming to clarify their stance—or lack thereof—on this matter.
